Ask Katrina: Leave while suspended
I am suspended with pay due to a workplace investigation that has been going for some weeks. Can I go away for a few days break due to stress during this time?
If an employee is suspended with pay at the employer’s initiative due to a workplace investigation, there is generally an expectation that they remain contactable and available to attend any meeting or request. If an employee wishes to take leave during an investigation process, they would generally have to utilise their own leave and the investigation would be delayed until their return.
Failure to attend a meeting without a reasonable excuse could also result in the employer taking further disciplinary action against you or making a decision on the available evidence without your input. If you are being assisted by the Association with the matter, you should also inform your support person if you are planning to be absent during an investigation as they also may need to contact you.
