Ask Katrina: Protection after a complaint
If I complain about my employment (such as filing a grievance), what happens if my employer takes action against me?
For employers outside of NSW Health this may constitute adverse action under the Fair Work Act 2009. For NSW Health employees, it may be victimisation under the Industrial Relations Act 1996 (NSW).
An employer cannot take action against you (for example issue you a warning or a reduction of your hours), as a result of exercising a workplace right (in this case if you make a complaint about your employment).
