Redundancy notice entitlements
I work in a NSW public hospital and I have just been made redundant. How much notice should my employer be giving me?
How much notice your employer should give you will depend on your length of service and your age. If you work in a NSW public hospital, the minimum notice you can be paid is 14 days as per clause 45(i) of the Public Health System Nurses and Midwives’ (State Award 2023).
However, you may be entitled to a greater notice period depending on your length of continuous service. If your length of continuous service is more than 3 years but not more than 5 years, the minimum notice period is 3 weeks. If you have more than 5 years of continuous service, then the minimum notice period will be 4 weeks as per section 117 of the Fair Work Act 2009 (Cth). If you are over the age of 45 and have completed at least 2 years of continuous service, you should also receive an additional week of notice.
Finally, although it is rare, your contract may specify a greater notice period. You should check your contract in case it provides for a more beneficial entitlement.
