Ask Shaye: Transmission in the workplace
There was a COVID-19 out-break in the facility I work in. I then got it. What leave am I entitled to?
This is an important question. Certain prescribed workers, including those in aged and disability care facilities, along with those in the healthcare sector (public and private), are presumed to have contracted the virus at work or while working. This reflects changes to the NSW legislation made in 2020 to make it easier for frontline workers to establish the link between work and contracting COVID-19. Of course, this presumption will not apply if there is evidence that proves a worker contracted COVID-19 outside of work.
Accordingly, any transmission that is likely to have occurred in the workplace should be approached as eligible for workers compensation.
