Independent Medical Examinations
I work at a public hospital, and I was required to attend an Independent Medical Examination (IME). I don’t agree with the outcome. Can I appeal it?
Yes, you can. If an employee does not agree with the outcome of an IME or believes there is conflicting evidence about their fitness for duty, they can appeal the IME assessment.
In this circumstance, you and your employer should agree on a different medical practitioner with expertise in the medical field that is relevant, to carry out a further and final review of your ability to return to work.
An employee always has access to the grievance and disputes resolution procedure in the relevant award or agreement if the matter is still not resolved.
